For decades, onsite burial using pits and land farming have been the primary means for disposing of energy waste. But on July 1, 2025, the new 16 Texas Administrative Code Chapter 4, Subchapter A replaced Statewide Rule 8 and has operators looking for alternatives. Here we are.

The new regulations make on site disposal costly, difficult, and risky.
Chapter 4 sets stringent new rules for the design, construction, operation, monitoring, and closure of waste pits. It also dictates how waste can be used in land farming. That means waste pits will have more requirements for registration, construction limitations, groundwater monitoring, and shorter closure deadlines. Land farming is now subject to stricter rules and is limited to low chloride water-based waste. Land farming also requires landowner permission, water source distance guidelines, no pooling or runoff, and post application requirements. Finally, waste haulers and disposal companies are now required to carefully track waste sources, types, volumes, and transportation destinations. If every detail isn’t handled perfectly, you’re at risk of being out of compliance.
